Toy Vehicles, Scooters, & Other Vehicles

Electrical Assisted Bicycle:
electric motor not exceeding 750 watts of power, and a top motor-powered speed of 20 mph.
• This classification includes all two and three-wheeled electric motors with 750 watts of power, and are equipped
with the mandatory safety equipment necessary for electric assisted bicycles to travel on public roadways.
• Both Colorado Revised Statute 42-4-221
Summary of laws regarding the use of electrical assisted bicycles in Broomfield:
• Electric assisted bicycles MAY be ridden on public roadways.
• Electrical assisted bicycle riders are not required to have a valid driver's license.
• Electrical assisted bicycles ridden on public roadways are not required to have a valid registration decal.
• Electrical assisted bicycles ridden on public roadways are not required to have insurance.
• Motorized Bicycle riders and passengers are not required to wear eye protection or wear safety helmets.
• Electric assisted bicycle riders must obey all laws applicable to other motor vehicles.

Electrical Personal Assistive Mobility Device:
Colorado Revised Statue 42-1-102(28.7) "Electric Personal Assistive Mobility Devices" or "EPAMD" means a self-balancing, non-tandem, two-wheeled device, designed to transport only one person, that is powered solely by an electric propulsion system producing an average power output of no more than 750 watts. The following are examples of EPAMDs and unclassified vehicles, regardless of whether they are gas or electric powered. This list is not all inclusive:
• Rad 2 Go (Similar to a Segway)
• Little Rascal
• Hoveround
Summary of laws regarding the use of EPAMDs in Broomfield:
•EPAMDs MAY travel on public roadways, except on limited access highways.
•EPAMDs MAY NOT travel on sidewalks.
•EPAMDs MAY NOT travel in ball fields, parks, recreational areas, bike trails, lake areas, or other areas commonly used for pedestrian or bicycle traffic.

Golf Carts:
Colorado Revised Statute 42-1-102(39.5) gives the following definition: "Golf car" means a self-propelled vehicle not designed primarily for operation on roadways and that has: a design speed of less than 20 miles per hour; at least three wheels in contact with the ground; an empty weight of not more than 1,300 lbs.; and a carrying capacity of not more than four persons.
Summary of laws regarding the use of golf cars in Broomfield:
• Golf cars MAY NOT travel on public roadways.
• Golf cars MAY NOT travel on sidewalks.
• Golf cars MAY NOT travel in parks, recreational areas, trails, or other areas commonly used for pedestrian or
bicycle traffic, with the exception of areas maintained and zoned or approved for golf course use.
Low-Power Scooters:
Colorado Revised Statute 42-1-102(48.5) states: "Low-power scooter" means a self-propelled vehicle designed primarily for use on the roadways with not more than three wheels in contact with the ground, no manual clutch, and either of the following: a cylinder capacity not exceeding 50 cubic centimeters if powered by internal combustion; or a wattage not exceeding 4,476 if powered by electricity. This classification includes all two- and three-wheeled vehicles with under 50 cc engines, regardless of whether they are gas- or electric-powered, and are equipped with the mandatory safety equipment necessary for vehicles to travel on public roadways. Both Colorado Revised Statute 42-4-201 et seq. and Model Traffic Code Part 2 address the various equipment requirements for motor vehicles permitted to travel on public roadways.
The following are examples of these vehicles. This list is not all inclusive:
• Road Scooters
• Mopeds (Kinetic or Hybrids)
Summary of laws regarding the use of low-power scooters in Broomfield:
• Low-power scooters MAY be ridden on public roadways.
• Low-power scooter riders must have a valid driver's license, but are not required to have a motorcycle
endorsement.
• Motorized Bicycles ridden on public roadways must have a valid registration decal.
• Low-power scooters ridden on public roadways are required to have insurance.
• Low-power scooter riders and passengers must wear eye protection.
• Colorado currently has no helmet law; however, riders and passengers under the age of 18 must wear a helmet. •
• Low-power scooter riders must obey all laws applicable to other motor vehicles.
• Low-power scooters MAY NOT be ridden on sidewalks, bike trails, parks, fields, or any other areas commonly used
by pedestrians and bicycles.

Low-Speed Electric Vehicles:
Colorado Revised Statute 42-1-102(48.5) states: "Low-speed electric vehicle" means a vehicle that is self-propelled utilizing electricity as its primary propulsion method; has at least three wheels in contact with the ground; does not use handlebars to steer; and exhibits the manufacturer's compliance with 49CFR 565 or displays a 17-character vehicle identification number. This classification includes all three- and four-wheeled vehicles, and are equipped with the mandatory safety equipment necessary for vehicles to travel on public roadways. Both Colorado Revised statute 42-4-201 et seq. and Model Traffic Code Part 2 address the various equipment requirements for motor vehicles permitted to travel on public roadways.
Summary of laws regarding the use of low-speed electric vehicles in Broomfield:
• Low-speed electric vehicles MAY be driven on public roadways with speed limits equal to or less than 35 mph.
• MAY NOT be operated on a limited access highway; however, they may be driven across a roadway that has a
speed limit greater than 35 mph so long as they are crossing over to another roadway with a speed limit equal to
or less than 35 mph.
• Operators must have a valid driver's license.
• Low-speed electric vehicles operated on public roadways must have a valid registration and are required to have
insurance.
• Low-speed electric vehicle drivers and passengers are not required to wear eye protection; however, the vehicle is
required to have a front windshield.
• Low-speed electric vehicle operators must obey all laws applicable to other motor vehicles.
Motorcycles/Scooters 50 cc and Over:
All two and three wheeled vehicles with 50 cc or larger engines, regardless of whether they are gas or electric powered, are considered motorcycles. Colorado Revised Statute 42-1-102(55) and Model Traffic Code 102(38), give the following definition: "Motorcycle" means every motor vehicle designed to travel on not more than three wheels in contact with the ground, except any such vehicle as may be included within the term "farm tractor" and except a motorized bicycle.

Summary of laws regarding the use of Motorcycles in Broomfield:
• Motorcycles MAY be ridden on public roadways.
• Motorcycle riders must have a valid driver's license with a motorcycle endorsement.
• Motorcycles ridden on public roadways must have valid registration (license plates).
• Motorcycles ridden on public roadways must have current liability insurance.
• Motorcycle riders and passengers must wear eye protection. Colorado currently has no helmet law.
• Motorcycle riders must obey all laws applicable to other motor vehicles.
• Motorcycles MAY NOT be ridden on sidewalks, bike trails, parks, fields or any other areas commonly used by
pedestrians and bicycles.

Off-Highway Vehicles:
The following items are examples of off highway or recreational vehicles, regardless of whether they are gas or electric powered.
• This list is not all inclusive:
• Four Wheelers or Quads
• Three Wheelers
• Dirt Bikes
• Go Carts
• All Terrain Utility Vehicles (whether wheeled or tracked)
Colorado Revised Statute 33-14.5-101 gives the following definition: Off Highway vehicle means any self propelled vehicle which is designated to travel on wheels or tracks in contact with the ground, which is designed primarily for use off of the public highways, and which is generally and commonly used to transport persons for recreational purposes. It does not include vehicles designed for travel in or on the water, snowmobiles, military vehicles, golf carts, wheel chairs, or vehicles used for agriculture, logging or mining.
Summary of laws regarding the use of Off Highway Vehicles in Broomfield:
• Off Highway vehicles MAY NOT be ridden on public roadways.
• Off Highway vehicles MAY NOT be ridden on bike trails, parks, fields, or recreational areas.
• Off Highway vehicles MAY be ridden on private property with the property owner's consent; however, the surface must be improved, not dirt or grass.
• There is an exception for private property owners for maintenance, construction or patrol on their property.

Toy Vehicles:
The following items are examples of toy vehicles, regardless of whether they are gas or electric powered. This list is not all inclusive:
• Stand Up Scooters (Go-Peds)
• Stand Up Scooters modified to be seated scooters (Go-Peds with a seat)
• Mini Motorcycles
• Razor E-Punk
• Seated Razor E-Scream Trike
• Razor Kamikaze Board
• Mini "Pocket" Bikes
Colorado Revised Statute 42-1-102 (103.5), gives the following definition: "Toy vehicle" means any vehicle that has wheels and is not designed for use on public highways or for off-road use. Toy vehicle includes, but is not limited to, gas- or electric-powered vehicles commonly known as mini bikes, "pocket" bikes, Kamikaze boards, go-peds, and stand-up scooters. Toy vehicle does not include off-highway vehicles or snowmobiles.
Summary of laws regarding the use of toy vehicles in Broomfield:
• Toy vehicles MAY NOT be ridden on public roadways.
• Toy vehicles MAY NOT be ridden on sidewalks, bike trails, parks, fields, or any other areas commonly used by
pedestrians and bicyclists.
• Toy vehicles MAY be ridden on private property with the property owner's consent; however, the surface must be
improved, not dirt or grass.

Wheelchairs:
Colorado Revised Statute 42-1-102(113) gives the following definition: "Wheelchair" means a motorized or non-motorized wheeled device designed for use by a person with a physical disability.
Summary of laws regarding the use of Wheelchairs in Broomfield:
• Wheelchairs SHALL travel on sidewalks when provided.
• Wheelchairs SHALL travel on a road shoulder as far as practicable from the edge of the roadway when sidewalks are not provided.
• Wheelchairs SHALL travel as near as practicable to an outside edge of the roadway when neither a sidewalk or road shoulder is available.
• In the case of a two way roadway, Wheelchairs SHALL travel on the left side of the roadway facing approaching traffic.
