Update: Court Enters Order on Extraction’s Temporary Restraining Order

On Monday, March 30 the City and County of Broomfield filed a motion requesting the courts reconsider a Temporary Restraining Order (TRO) granted to Extraction Oil and Gas on March 27, 2020. The TRO expiring on April 10 prohibited Broomfield from issuing a Public Health Order suspending oil and gas flowback operations at the Livingston Pad for the duration of the state’s stay at home order.   Extraction Oil and Gas then filed a complaint.  All of the Court pleadings by Extraction and Broomfield can be viewed here.  On April 6th the Judge entered this order that concluded in part that Extraction’s request for a temporary restraining order and preliminary injunction is not yet ripe for adjudication because the Broomfield Board of Health has not yet enacted an emergency ordinance on public health order that temporarily requires Extraction to cease its scheduled flowback operations at its Livingston Well Site.
