ADA and Accessibility Process and Procedures
The City and County of Broomfield will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in the City and County of Broomfield programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision disabilities.
Submitting a Grievance or Request for Assistance
STEP 1: File a Grievance and Request Form
To file any ADA grievance or request, including those related to digital accessibility, use the online ADA and Accessibility Grievance and Request Form. You do not have to create an account on the website in order to fill out and submit the form. If you need assistance completing this form or require a different format or other accommodation, please contact the ADA Coordinator at ada@broomfield.org or by calling 303-464-5176.
Please make sure to fill out the form in its entirety, including your signature and date, submitting it.
STEP 2: An Investigation is Conducted
A notice of receipt shall be mailed to the requestor by email within five days of receipt of the grievance or request. The ADA Coordinator shall begin an investigation into the merits of the grievance or request within 30 days. If necessary, the requestor may be contacted directly to obtain additional facts or documentation relevant to the grievance or request. If the requestor alleges misconduct on the part of the ADA Coordinator or Risk Management, another authorized representative may be appointed by the City Manager at their discretion to conduct the investigation.
STEP 3: A Written Decision is Prepared and Sent to the Requestor
The ADA Coordinator shall prepare a written decision after full consideration of the grievance or request merits, no later than 30 days following the receipt of the grievance or request. If the grievance or request alleges misconduct on the part of the ADA Coordinator or Risk Management, another authorized representative may be appointed by the City Manager at their discretion. A copy of the submitted grievance or request, written decision and responses shall be retained by Risk Management for a period of three years.
STEP 4: A Requestor may Appeal the Decision
If the requestor is dissatisfied with the written decision, the requestor may file a written appeal with the City Manager, no later than 30 days from the date of the mailing of the decision. The appeal must contain a statement of the reasons why the requestor is dissatisfied with the written decision, and must be signed by the requestor, or by someone authorized to sign on the requestor’s behalf.
A notice of receipt shall be mailed to the requestor by email within five days of the receipt of the appeal. The appeal reviewer shall act upon the appeal no later than 60 days after receipt, and a copy of the appeal reviewer’s written decision shall be mailed to the requestor by email or regular mail. The decision of the appeal reviewer shall be final. A copy of the written appeal and decision shall be maintained by Risk Management for a period of three years.
Filed Grievance and Request Procedures
The ADA Coordinator and Risk Management shall maintain the confidentiality of all files and records relating to grievances and requests filed, unless disclosure is authorized or required by law or permission is given by the requestor to release the information. Any retaliation, coercion, intimidation, threat, interference or harassment for the filing of a grievance, or used to restrain a requestor from filing, is prohibited and should be reported immediately to the ADA Coordinator.
The ADA and Accessibility Grievance and Request Form and process are designed to provide you with the opportunity to effectively resolve any ADA and Accessibility issues that you may have with the City and County of Broomfield. Filing an ADA and Accessibility grievance or request or not with the City and County of Broomfield does not affect your right to file a grievance or request with the Department of Justice.
