Broomfield uses the term Income-Aligned Housing as a more accurate term that aligns different types of housing for different incomes. We work to:

  • Provide programs and services to help residents remain housed

The Housing Division collaborates with developers to create diverse housing options for low, moderate, and middle-income residents, in addition to the market rate options. Our goals include providing a wide range of housing options to meet a wider variety of needs.

As part of the pre-application process for residential development, the Broomfield Planning Department as well as the Housing Division require information regarding how the developer plans on meeting the requirements of the Inclusionary Housing Ordinance.

If you are a developer of Affordable Rental Developments seeking LIHTC funding and your concept has been approved by the Broomfield City Council or planning, the City and County of Broomfield may have opportunities to provide some gap financing.

Broomfield’s Right of First Refusal (ROFR) and Right of First Offer (ROFO) for Qualifying Property for Affordable Housing

Colorado’s ROFR and ROFO law is detailed in C.R.S. 29-4-1201 et seq., as adopted pursuant to HB24-1175.

A qualifying property is required to give certain notices to the City and County of Broomfield under the new law.
In accordance with C.R.S. 29-4-1202(2)(f)(I) and C.R.S. 29-4-1203(2)(d), Broomfield has assigned its ROFR and ROFO to purchase to the Broomfield Housing Alliance (BHA), Broomfield’s housing authority.

This notice is valid through Dec. 31, 2029.

Attainable Homeownership 

The Inclusionary Housing Ordinance outlines a variety of housing styles and types that would be made available for middle-income earners seeking to purchase a home below market rate. It’s utilized by Broomfield to increase access and opportunity for income-aligned housing. 

Key Highlights 

  • Annual Verification Form for Current Homeowners: All homeowners of one of the City and County of Broomfield’s Inclusionary Housing Ordinance are required to fill out an annual verification to stay in compliance with the Broomfield Ordinance (Chapter 17-76 of the Municipal Code). Specific requirements must be met throughout the 30-year deed-restricted period, specifically when refinancing, remodeling/capital improvement, and/or upon resale of your home. All borrowers must live in the home. Annual Verification Letters (En Español) will be sent to all deed-restricted homeowners in July. All borrowers must fill out this form by September 30 each year. 
  • Housing Supply: Broomfield aims to increase attainable housing by 3% annually City and County of Broomfield are following the Division of Local Affairs state goals set by Proposition 123 
  • Eligibility: Homes target households earning 80-100% of Area Median Income (AMI) 
  • Long-Term Affordability: 30-year deed restrictions protect ongoing affordability

Important Considerations 

  • Homes are sold below market value 
  • Annual equity growth is capped at 3.5% 
  • Resale requires selling to income-qualified buyers 
  • All resales and refinances MUST be verified by the Housing Division

Renters

The City provides financing for rental developments that offer affordable housing to: 

  • Lower-income earners (30-50% AMI) 
  • Middle-income earners (50-80% AMI) 

Developers receive public financing in exchange for maintaining reduced rental rates for qualifying residents. Please see below for housing availability 

Low-Income Housing Tax Credit (LIHTC) Housing (Affordable Rental) 

This Tax Credit targets households earning 30-50% AMI. Eligibility is based on income, and allocation is first-come, first-served.
